This brand deal has a perpetual rights clause. Is that normal?
AI
No. Perpetual rights let the company use your name, image, or likeness forever, in any medium, without extra payment. A clause like this usually has a fixed term - often 1-3 years. Here’s what to look at next...

What athletes find out too late

The fine print is where it gets expensive.

01

The tax bill no one warned you about

NIL income arrives with no withholding. On top of regular income tax, there is a 15.3% self-employment tax - plus quarterly estimated payments due four times a year. Many athletes find out in April, after the money is spent.

Surveys suggest most first-time earners are caught off guard by NIL taxes.

02

The agent who takes a big cut

Some agents charge 15-30% of NIL deals, far above what established pros pay. The clause that locks in that commission - and can extend it to future earnings - is easy to miss in the fine print.

Commission terms are almost always negotiable, if you catch them in time.

03

The clause you only notice later

Perpetual image rights, exclusivity, and exit fees can sit quietly in a contract until they cost you. The terms are there when you sign, whether or not anyone points them out.

A careful read before signing is the cheapest protection there is.
